This 'promoter', one Tim Sun Dog booked NRPS for almost a year without ever coming up with the guarantee (deposit), then abruptly cancelled NRPS 2 weeks ago. Also, without notice to us.
He publishes several lame reasons as to why this occurred, inferring as well that NRPS had been the party cancelling. This was all bogus – it is an out and out lie. He did this action when it appeared that his ticket sales were lagging. He cancelled 2 of the highest dollar bands on the bill – New Riders and Donna Jean & The Tricksters. By dropping NRPS he was saving himself a 6500 dollar guarantee, ripping us off, deceiving the public!
Last night, I was sitting here on the tour bus listening to the conversation Tim Sun Dog was having with my Tour Mgr. after he reneged when called by our Crew Chief to 'advance' the show. Apparently Tim S.D. was complaining about my blogging concerning his deception (oh well!), our Tour Mgr. told him to clean up his act, to publicly tell the truth to the fans and public at large the truth. And to change the billing on his advertisement of the show. To wit: Take our (NRPS) name OFF his online flyer. He was still suggesting that we were going to possibly appear! Fraud.
Toast gave him 2 hours to get honest, to admit fault and be truthful to the public. At the same time and over this period of 2 weeks, Tim S.D. has been verbally abusive to fans wanting their money back, since it had leaked that NRPS would NOT be playing at his show on July 31.
So far, no honest retraction or apology has been witnessed by this band.
This petty rip-off is nothing more than a cheap, two-bit swindle. And he STILL persists perpetrating this fraud in the name of Jerry Garcia. DON'T GO. Boycott this clown. The Garcia estate should sue this clown for using Jerry's name in such a deception!

So, sounds like the guys did not sign a contract at the time of the booking. Secure the deposit, and write a penalty in for cancellation next time around, guys. Don't they have a business manager???
As for using the band name in promotions: that is what attorneys are for.

"Due to unforeseen conditions, Donna Jean & the Tricksters regretfully will not be able to perform at the 2008 Grateful Garcia Gathering. We apologize for any inconvenience. Also, we at the GGG really want to make it clear that New Riders of the Purple Sage very much wanted to play the 3Gs and perform for their fans, and would have for less than the agreed upon fees, as long as they didn’t lose money. Unfortunately, with our financial state, it was not possible for us to be able to cover their deposit of 50% of the guarantee. They went well out of their way to try make this happen, but we had to make the decision to cancel the New Riders. We're very bummed out about our discision, but it was the right thing to do. -Tim Sundog"
Sounds like an explanation and an apology for me. In addition, nowhere on the website or their myspace page do they claim or imply the NRPS or Donna Jean and the Tricksters will be there. Nowhere at all. Plus, the line-up still looks pretty solid for a small mid-west festival: Jackie Greene Melvin Seals and JGB, with Stu Allen David Gans Moonalice, featureing BARRY SLESS, PETE SEARS and Jack Cassady Boombox (which, IIRC is the project of Donna Godcheaux's son)
I highlighted Barry Sless and Pete Sears because they certainly have some relationship with David Nelson, if not NRPS. They don't seem to think this is a dishonest fraud. All of those performers have some real connection to the Grateful Dead milieu.
And a promoter "verbally abusing" fans...Bill Graham is having a good laugh over that one somewhere, isn't he?
It's too bad NRPS couldn't be part of this, I guess. But there appears to be more to this than mszshelly's blog lets on.

Always good to get the deposit up front at the time of the booking ... otherwise, there is no booking, eh?
